Czech citizens and foreigners can get a Czech trade license. This includes EU, EEA, and Swiss citizens as well as non-EU citizens.
You do not need Czech citizenship to become self-employed under the Czech Trade Licensing Act.
You must meet the general legal conditions for operating a trade and any additional conditions that apply to your particular type of business activity.
KEY FACT
Foreigners can get a Czech trade license. Citizenship does not prevent you from registering a trade in the Czech Republic.
The exact procedure and required documents differ according to your citizenship, residence status and the type of trade you want to operate.

What are the general conditions for getting a Czech trade license?
An individual must satisfy two general conditions:
Full legal capacity (plná svéprávnost)
Good character / integrity (bezúhonnost)
These are the general conditions established by the Czech Trade Licensing Act.
Some business activities have additional professional or other requirements.
KEY FACT
Professional qualifications are not required for every Czech trade license.
Whether qualifications are required depends on the type of trade you want to operate.
Do you need professional qualifications?
Not for a free trade.
A Czech free trade (živnost volná) does not require proof of professional competence. This category covers many activities used by freelancers and self-employed professionals.
Craft, regulated/tied and concession trades have additional requirements.
Professional Qualification Requirements by Czech Trade Type
Trade category | Professional qualification |
|---|---|
Free trade | Not required |
Craft trade | Required |
Regulated/tied trade | Required |
Concession trade | Specific statutory requirements apply |
Can EU citizens get a Czech trade license?
Yes. EU citizens can get a Czech trade license.
Czech citizenship is not required.
The Czech Ministry of Industry and Trade provides a dedicated trade-licensing procedure for foreign natural persons who are citizens of the EU, EEA or Switzerland.
EU citizens must satisfy the applicable trade-licensing conditions, but they do not need to establish a Czech company simply because they are foreigners.
KEY FACT
An EU citizen can operate as a self-employed individual with a Czech trade license.
Do EU citizens need Czech temporary residency to get a trade license?
No. EU citizens do not need Czech temporary residency or an EU Registration Certificate before registering a Czech trade license.
Trade License Registration and EU residence registration are separate procedures.
Pexpats regularly handles Trade License Registration independently from Temporary Residency/Registration Certificate applications.
Pexpats client cases also confirm that the residence-registration process can still be pending while the Trade License Registration process proceeds.
PRACTICAL PEXPATS NOTE
An EU citizen does not need to complete temporary residency registration before getting a Czech trade license.
Can EEA and Swiss citizens get a Czech trade license?
Yes.
Citizens of EEA countries and Switzerland can also get Czech trade authorization.
The Czech Ministry of Industry and Trade groups EU, EEA and Swiss citizens together in its dedicated trade-license guidance for foreign natural persons.
The documents needed for registration depend on the applicant’s situation and the type of trade.
Can non-EU citizens get a Czech trade license?
Yes. Non-EU citizens can get a Czech trade license.
Non-EU citizenship does not prevent a person from becoming self-employed in the Czech Republic.
However, non-EU citizens follow different rules from EU/EEA/Swiss citizens. Their residence status affects the registration procedure and the documents that must be provided.
The Czech Ministry of Industry and Trade therefore publishes a separate official procedure for foreign natural persons who are not citizens of the EU, EEA or Switzerland.
WARNING
Do not use EU-citizen registration requirements for a non-EU applicant.
Both groups can get Czech trade authorization, but the registration requirements are different.
Do non-EU citizens need Czech residence authorization?
A non-EU citizen’s residence status is part of determining the correct Trade License Registration procedure.
Trade authorization and immigration authorization are separate legal matters.
A Czech trade license gives you authorization to conduct the registered trade. It does not by itself give a non-EU citizen permission to reside in the Czech Republic.
Likewise, holding Czech residence authorization does not automatically mean that every requirement for Trade License Registration has been completed.
KEY FACT
Trade authorization and immigration authorization are two different things.
For non-EU citizens, both must be considered according to the person’s residence situation.
Can a non-EU family member of an EU citizen get a Czech trade license?
A non-EU family member of an EU citizen can get a Czech trade license. Their residence documentation determines which supporting documents are required during registration.
Pexpats practical cases provide a clear example:
A non-EU spouse can proceed with Trade License Registration after obtaining a bridge visa together with a criminal-record certificate bearing the required apostille.
A non-EU spouse who has already received the relevant biometric residence card can proceed without providing the criminal-record certificate in this process.
PRACTICAL PEXPATS NOTE
The applicant can be eligible for a trade license while the exact document requirements differ according to residence status.
Do you need permanent residence in the Czech Republic?
No. Czech permanent residence is not required to get a Czech trade license.
Foreign nationals without Czech permanent residence can obtain Czech trade authorization when they satisfy the conditions applicable to them.
The Czech Ministry of Industry and Trade specifically provides trade-licensing procedures for foreign natural persons.
Residence status can affect how you register and which documents you provide, but Czech permanent residence itself is not a general eligibility requirement.
Do you need to be a Czech tax resident?
No. You do not need to be a Czech tax resident to have a Czech trade license.
A person can legally operate a Czech trade license while being a Czech non-tax resident. This also occurs in Pexpats’ real client cases.
Trade-license eligibility and tax residency are separate concepts.
Your trade authorization determines whether you are legally authorized to conduct your registered business activities.
Your tax residency determines which country treats you as a tax resident and how the applicable tax rules affect your income.
KEY FACT
A Czech trade license does not automatically make you a Czech tax resident.
Do you need a Czech business address?
Yes. A Czech trade requires a registered business address.
The business address does not determine whether a Czech citizen or foreigner is eligible for a trade license, but it forms part of establishing the business.
Depending on the situation, the entrepreneur can use premises for which they have the required legal right of use.
Pexpats works with foreign entrepreneurs who use their residential address with the required property-owner consent as well as entrepreneurs who use a separate business-address service.
Can you get a Czech trade license while working as an employee?
Yes.
Employment does not prevent you from having a Czech trade license.
You can work for an employer and simultaneously conduct your own business as a self-employed person.
Your self-employment can then be classified as main or secondary activity for social-insurance purposes depending on your circumstances.
KEY FACT
Being employed does not prevent you from registering or operating a Czech trade license.
Can student get a Czech trade license?
Yes.
Being a student does not prevent you from obtaining a Czech trade license when you meet the applicable trade-licensing conditions.
Student status can affect other obligations connected with self-employment, particularly the treatment of social insurance, but it does not itself prevent Trade License Registration.
Can a company have a Czech trade license?
Yes.
Trade authorization is available to both natural persons and legal persons.
An individual freelancer operates personally as a self-employed person. A company such as an s.r.o. is a separate legal entity and can hold the trade authorizations required for its business activities.
KEY FACT
Czech trade authorization is not limited to freelancers or individual entrepreneurs. Companies can also hold trade authorization.
Who cannot get a Czech trade license?
A person cannot legally operate a trade unless the applicable conditions are satisfied.
Trade authorization cannot be obtained or operated in the ordinary way when:
the general legal conditions are not satisfied;
the activity requires professional competence and that requirement has not been met;
the activity requires a concession and the necessary conditions have not been satisfied;
requirements applying to the foreign applicant’s particular status have not been completed;
the activity is excluded from the Trade Licensing Act and is instead governed by separate legislation.
Eligibility therefore depends on two questions:
1. Is the person eligible to operate the trade?
2. Does the person satisfy the requirements for that particular activity?
